Oracle invokes force majeure over New Mexico AI data center delays
The computing giant cites uncontrollable events to shield itself from payment obligations as Project Jupiter faces energy supply and permitting hurdles.

Oracle has issued a force majeure notice regarding Project Jupiter, a major Stargate AI data center campus under development in New Mexico. The move allows Oracle to delay payments if the facility misses its 2028 operational target, though the company maintains it is not attempting to withdraw from the project entirely.
What force majeure means for this deal#
Force majeure clauses are standard in contracts involving energy and commodities—they free parties from their obligations when circumstances beyond their control intervene. In this case, Oracle's notice would protect the company financially if external impediments cause construction delays, without requiring the firm to abandon its role as the campus's primary tenant.
Mounting obstacles to the project timeline#
Project Jupiter has encountered a series of complications, primarily related to energy infrastructure. The facility is designed to consume 2.45 gigawatts of power and will rely on gas-fueled fuel cells manufactured by Bloom Energy, making a steady gas supply essential to meeting deadlines.
A major complication: Energy Transfer's natural gas pipeline meant to feed the site has slipped nearly half a year, now expected to begin operation February 1, 2027, after regulators rejected multiple permit applications. The project's route was also rerouted in August following those initial denials. Additionally, the state environmental department must rule by November 23 on a separate air-quality permit for the fuel cell system.
Reassurances from both sides#
Oracle told CNBC that "Project Jupiter remains on our planned schedule" and emphasized its commitment to the state. Blue Owl Capital, which received the force majeure notice, stated through CNBC that the announcement does not alter its financial obligations to the multi-year initiative.
Broader context and opposition#
The notice arrives as AI infrastructure projects nationwide face heightened regulatory and environmental scrutiny. Project Jupiter is a flagship component of Stargate, the AI infrastructure partnership announced by Oracle, OpenAI, and SoftBank alongside President Donald Trump. The campus has become politically contentious, drawing criticism from local residents and environmental advocates ahead of midterm elections, prompting Oracle to launch a public relations campaign to build support.
